The cost of a gap in the filing went up on August 5, 2026
USCIS Policy Alert PA-2026-05 changed what happens to a petition that arrives incomplete. Three of the changes land directly on drafting practice.
Denial without an RFE
Officers may now deny a petition outright, without first issuing a Request for Evidence or a Notice of Intent to Deny, when the filing does not include all required initial evidence.
Shorter response windows
The ceiling on response time has not moved, but officers are no longer expected to grant all of it. The notice sets the deadline, and USCIS generally cannot extend it.
A partial response closes the record
Answering part of an RFE is treated as a request for a decision on the record as it stands. Whatever is still missing at that point stays missing.

We are looking for a small number of founding firms
Exelita is new to firms, and we would rather say that than pretend otherwise. So the first few firms are not a normal sale. They get the platform on terms we will agree directly, and in exchange we ask for two things: permission to say publicly that you use it, and an honest measurement of what it did to your time per petition.
That is the trade. You get the infrastructure early and cheaply. We get the two things a new entrant cannot buy at any price.

What Exelita is not
- Does this replace our case management system?
- No. Clio, MyCase, Docketwise and the rest handle matters, deadlines and billing. This handles drafting and evidence. They sit alongside each other and we would rather say that plainly than imply a displacement that is not true.
- Our paralegals already use AI. What is different?
- General-purpose chatbots do not give your firm a matter-level approval gate or a named audit trail, and they can drift toward repetitive template language. Exelita drafts from case-specific evidence and firm style references, then logs every action against a named actor.
